LLM Fair Housing Law and Litigation

2 Years On Campus Masters Program

Tulane University

Program Overview

With SCOTUS recently recognizing discriminatory effects claims under the Fair Housing Act (FHA) and U.S. HUD issuing the first comprehensive regulation interpreting affirmative governmental fair housing duties in 2015, a study of fair housing law and litigation is particularly timely. This course will examine Title VIII of the Civil Rights Act of 1968, as amended in 1988; classes protected; transactions covered (rental, sales, lending, insurance); and the fair housing obligations of states, municipalities, and public and affordable housing programs. Students will be challenged to consider the strengths and weaknesses of litigation as a tool for creating an equal housing market and eradicating residential segregation. This course will incorporate doctrine, theory, and practice and will be assessed using a midterm exam and several writing assignments.
