Program Overview

The course provides an overview of a variety of topics that fall under the umbrella of health care law, in particular addressing the laws that affect major portions of the health care industry and those it serves. Relationships among individual health care providers (e.g., physicians), institutional providers (e.g., hospitals, nursing homes, clinics), and patients of those providers are explored, as are various statutory entitlements (e.g., Medicare, Medicaid, EMTALA), practical concepts such as licensing, regulation and accreditation of institutions and professionals, health care financing and payment models, taxation concepts and insurance regulations, as well as prevalent topics in health care related contracts, such as restrictions on health care contracting and specifically anti-referral laws. Other topics include, patient privacy/consent issues and HIPAA mandates, the policing of fraud and abuse, medical malpractice, ethical issues and legal matters related to medical staff, to name a few.
